Terms of Service

These Terms of Service were last updated on October 9, 2025. Please read these Terms of Service carefully before using our Service.

Introduction

Welcome to the GuideTrackee® service (the Service). By accessing or using our services, you agree to comply with and be bound by these Terms of Service (Terms). Please read them carefully. If you do not agree to these Terms, you may not use the GuideTrackee® service.

Company

The GuideTrackee® service is provided by WTG Solutions sp. z o. o., 30-428 Kraków, ul. Zdunów 22F/5, NIP 6793303306, KRS 0001113840. In this Terms of Service document, the Company refers to WTG Solutions sp. z o. o.

Eligibility

The GuideTrackee® service is available to legal entities (You) located in Poland that have a valid Polish tax identification number (NIP) and to customers of such legal entity who have received GuideTrackee® access tokens (Token) from you, as well as to natural persons (You) and other persons to whom you have made GuideTrackee® access tokens available. By using the Service, you represent and warrant that you meet these requirements.

Acknowledgment

This is the Terms of Service for the GuideTrackee® service and the agreement that is in effect between you and the Company. These Terms of Service set forth the rights and obligations of all users using the Service.

Your access to and use of the Service is also conditioned on your acceptance and compliance with the Company's Privacy Policy. Our Privacy Policy describes our policies and procedures regarding the collection, use, and disclosure of your personal information when you use the Service and informs you about your privacy rights and how the law protects you. Please read our Privacy Policy carefully before using our Service.

Account Registration

To access the Service, you must register an account. You must provide accurate and complete information during the registration process and keep it current. If you represent a legal entity, a valid tax identification number (NIP) is required.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately if you suspect any unauthorized use of your account.

Use of the Service

The GuideTrackee® service enables tour registration and issuing of GuideTrackee® access tokens for tours to your direct customers (guides, supervisors, or members) or other natural persons. Depending on the type of tour, different services are provided:

To use the GuideTrackee® service, your customers or persons to whom you provide GuideTrackee® access tokens must use the GuideTrackee® mobile application. It is available for iOS and Android operating systems.

Content

You may have the ability to upload, post, or share content through the Service. By doing so, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, distribute, and display your content.

We reserve the right to remove or modify any content that violates these Terms or is otherwise unacceptable, at our sole discretion. All content made available through the GuideTrackee® service, including text, graphics, logos, and software, is the property of the Company and is protected by copyright and other intellectual property rights.

The Company is not responsible for user content in the Application. You expressly understand and agree that you bear sole responsibility for content and any actions taken under your registered account, whether taken by you or by GuideTrackee® service users associated with your account through GuideTrackee® access tokens. You may not upload any content that is illegal, offensive, annoying, intended to cause disgust, abusive, defamatory, slanderous, obscene, or otherwise unacceptable. Examples of such inappropriate content include, but are not limited to:

The Company reserves the right, but not the obligation, at its sole discretion, to determine whether any Content is appropriate and compliant with these Terms, to block access to the Service.

Subscription and Payments

Some features of the GuideTrackee® service may be available under subscription plans. Details of subscription plans, including prices and billing cycles, will be provided at the time of purchase. You agree to pay all subscription-related fees in a timely manner. We may use third-party payment processors to process payments required to access the Service. By providing your payment information, you authorize us to charge applicable fees from your payment method.

You may stop using GuideTrackee® at any time, but usage costs will not be refunded. We reserve the right to offer refunds at our discretion.

To simplify internal payments, we use internal credits (C) that must be purchased to issue access tokens. By purchasing GuideTrackee® credits, you consent to the delivery of purchased credits immediately after payment and thereby consent to waive your right to withdraw from the contract within 14 days of purchase.

Service Pricing

The service for end users, i.e., guides, supervisors, and users, is provided through Access Tokens. To issue a token, a certain number of internal credits is required, as specified below:

The minimum tour duration is 2 hours.

Complaints

In case of incorrect crediting of access credits or incorrect account charges when creating an event and issuing GuideTrackee® access tokens, complaints can be submitted to office@guidetrackee.com. The complaint should include your name, address, NIP (if applicable), address, email, and description of the problem. Complaints will be processed within a maximum of 30 days.

Privacy Policy

Your use of the Service is also subject to our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy.

Termination

You may close your account at any time by contacting us at office@guidetrackee.com. After account deletion, your right to use the Service will immediately expire, and your data, except those necessary to maintain billing records, will be deleted. Unused access credits will also be deleted. Financial funds for their purchase will not be refunded.

We may close or suspend your account or access to the Service at our discretion, without notice, for any reason, including violation of these Terms.

Disclaimers and Liability Limitations

The Service is provided on an "as is" and "as available" basis. We provide no warranties, express or implied, regarding the operation or availability of the Service. To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages arising from use of the Service.

Governing Law

These Terms are governed by and shall be interpreted in accordance with Polish law, without regard to conflicts of law.

Changes to These Terms

We may update these Terms from time to time. Any changes will be posted on this page, and the "Last Updated" date will be changed. Continued use of the Platform after any changes are made constitutes acceptance of the new Terms.
